1. Agreement
By creating an account or sending messages through ZenSMS GH ("ZenSMS", "we", "us") you agree to these terms. If you are agreeing on behalf of a business, you confirm you are authorised to do so.
2. The service
ZenSMS provides bulk SMS delivery to Ghanaian mobile networks — MTN, Telecel and AT — through a licensed SMS aggregator. You buy credits, upload contacts, and send messages under a sender name registered to you.
3. Your account
- Give accurate business details when you register, and keep them up to date.
- Keep your password secure. You are responsible for everything sent from your account.
- Tell us promptly at support@zensmsgh.com if you think your account has been accessed by someone else.
- One account per business. Do not resell access to your account without our written agreement.
4. Sender names (sender IDs)
- Sender names must be registered with the National Communications Authority before they can be used. We handle that submission for you.
- You may only register a name you own or are authorised to use.
- You must not use a name that imitates a bank, mobile network, government body or any other organisation you do not represent.
- We may refuse or withdraw a sender name if it breaches these rules, if the regulator or a network objects, or if it generates complaints.
5. Acceptable use
You may only message people who gave you their number for this purpose. Buying, scraping or borrowing contact lists is not permitted. Complaints get sender names blocked by the networks, which affects every customer we serve — so we enforce this strictly.
You must not use ZenSMS to send:
- scams, fraud, phishing, or messages designed to trick people into sending money or sharing PINs, passwords or one-time codes;
- messages impersonating another person, business, bank, network or public body;
- content that is unlawful in Ghana, including messages promoting illegal goods or services;
- threatening, harassing, hateful or obscene content;
- links to malware, or any attempt to compromise a recipient's device;
- messages to numbers on your opt-out list, or to anyone who has asked you to stop.
You must include a clear way for recipients to opt out — for example a WhatsApp or phone number in the message — and you must honour those requests. Opt-outs recorded on the platform are skipped automatically in every future campaign.
You are responsible for complying with Ghanaian law and the National Communications Authority's rules in respect of the people you message.
6. Credits and payment
- Credits are bought upfront in Ghana cedis, in the bundles shown on our pricing page.
- Messages are charged per segment. One SMS segment is 160 characters of standard text; accented characters and emoji reduce a segment to 70 characters, so a longer or emoji-containing message uses more than one credit. The composer shows the count before you send.
- Credits do not expire while your account is active.
- Credits are not transferable between accounts and are not exchangeable for cash.
- Unused credits may be refunded at our discretion, less any costs already incurred. Credits already spent on delivered messages are not refundable.
- Prices may change; we will give notice before a change affects your rate, and any change applies to future purchases, not to credits you already hold.
7. Delivery
We pass your messages to a licensed aggregator and on to the mobile networks. Once a message reaches the network, delivery is in their hands. We cannot guarantee that every message will be delivered, or the exact time of delivery — a handset may be switched off, out of coverage, barred, or the number may no longer be in use.
Where a message fails permanently, the platform records it as failed in your delivery report. We do not charge you for messages the network rejects outright before delivery is attempted.
8. Suspension and termination
We may suspend or close an account that breaches these terms, generates significant complaints, appears to be sending fraudulent messages, or where a network or regulator instructs us to. Where circumstances allow, we will contact you first. For serious cases — fraud in particular — we may suspend immediately.
You may close your account at any time by writing to us.
9. Availability
We work to keep the platform available and messages moving, but the service is provided "as is" without a guaranteed uptime level, unless we have separately agreed a service level in writing with you. Maintenance, network outages and aggregator issues can interrupt service.
10. Liability
To the extent permitted by Ghanaian law, our total liability to you in connection with the service is limited to the amount you paid us in the three months before the event giving rise to the claim. We are not liable for indirect or consequential loss, including lost profits, lost business or lost opportunity arising from undelivered or delayed messages.
Nothing in these terms limits liability that cannot be limited by law.
11. Your data
How we handle personal data — including the contact lists you upload — is set out in our Privacy Policy. In short: you control your contact lists, we process them on your instructions, and we never use them for our own purposes.
12. Changes to these terms
We may update these terms. The date at the top of this page shows the current version, and we will notify customers by email of changes that materially affect them. Continuing to use the service after a change means you accept the updated terms.
13. Governing law
These terms are governed by the laws of the Republic of Ghana, and the courts of Ghana have jurisdiction over any dispute.
